Giuseppe Calabi represented the J. P. Getty Trust in an important dispute before Italy’s highest administrative Court (Consiglio di Stato), where it was stated that the painting by Jacopo Bassano, The Miracle of the Quails, 1554, can remain at the Getty Museum in Los Angeles.

The legal dispute arose from the Italian Ministry of Culture decision in January 2022 to annul the export licence for the painting, acquired by the Getty Trust in 2021, and order its repatriation to Italy. The Ministry claimed the export licence contained false information, and the painting’s condition was misrepresented.

However, the Consiglio di Stato dismissed the Ministry’s claim, deeming the annulment illegitimate and highlighting errors by the licensing committee in undervaluing the artwork.

The decision is considered significant for the international circulation of artworks with Italian provenance, as it establishes a precedent for more careful consideration when annulling export licences.
